Assistance with legal

Our experience with
regulatory work (including
Chris Peace acting as an
expert witness) has left us
in no doubt that most legal
compliance programmes only
work in the short- to
medium- term. They focus too
much on what the law says
rather than on how to adapt
policies, practices and
procedures to what the law
requires.
Thus, we do not offer
computerised “tick-box”
compliance systems. We
prefer to work with clients
to adapt or develop embedded
work procedures that are
focused on achievement of
objectives while ensuring
compliance with legal
requirements.
Research has shown that
embedding compliance in
routine work practices is
the best long-term strategy
for compliance. An
Australian standard, AS 3806
Compliance programmes has
been adopted in New Zealand
and sets out principles for
compliance.
Such an approach
demonstrates to regulatory
agencies that the
organisation has commitment
to compliance. It can lead
to a willingness to give a
warning for a breach rather
than starting a prosecution.
Our approach to embedding
legal compliance has the
additional advantage that it
can be further developed
into a corporate social
responsibility programme.
However, research suggests
that many corporate social
responsibility programmes
may not be viable in the
longer term because they
fail to add value for
stakeholders.
